The general conditions of sale apply exclusively to commercial relations between:

owner of all rights to the Ottomobile website.
Ottomobile is the trademark of MINI EXPRESS.
And any natural person who has passed an order or a reservation via the website https://otto-models.com/fr/, by telephone with from Ottomobile customer service and/or by mail.
Consequently, the fact for a person physical, to order on the Ottomobile website, by telephone or by mail, takes full acceptance of these general conditions.
Any order of products is strictly reserved for the end consumer, i.e. any natural person not acting in quality of merchant.

Before any validation of your online order, the summary page allows you to check the content, and possibly modify it.
The validation of your order means that you accept the offer and these general conditions of sale. We will acknowledge receipt of your order by email. This email constitutes our confirmation of registration of your order. Orders by mail and by telephone are validated as soon as receipt of your order. You will receive the product ordered, subject to availability and/or acceptance of your order.
MINI EXPRESS reserves the right to cancel any order abnormal nature, and in particular an order relating to quantities of products exceeding the needs normal orders from a consumer or abnormal successive orders to the same name and address of billing and/or delivery. Similarly, MINI EXPRESS reserves the right to refuse an order in the event of a debit balance and/or payment dispute on a previous order.
The sale will not be considered as definitive only after the sending of the product as well as the receipt of the full price. The general conditions of sale applicable to your order are those available on the date of your order.
You have the possibility to cancel your order only in the event that your order is not “In preparation” in your customer area.
You agree to obtain the invoices for your purchases electronically. Electronic invoices will be made available to you at .pdf format in the space of your customer account on our website.
All our prices indicated take into account the VAT of each European country, it is expressed VAT included.
The prices of our products do not include transport costs. Expenses shipping costs are based on the weight of the products and the destination.
The prices indicated are subject to change at any time without notice. However, the articles will be invoiced on the basis in in force when the order or reservation is registered.
In the event of an order for a other country than mainland France, customs duties or other local taxes (local VAT, customs, import duties, etc.) may be payable. These rights are the responsibility of exclusive to the customer and are his entire responsibility both in terms of declarations and payment to the competent authorities.
All orders, regardless of their origin, are invoiced and payable in Euros only.
The products remain the property of MINI EXPRESS SARL until full payment of the price, regardless of the date of delivery of the product.
WAY OF PAYMENT
There are several ways to pay for your purchases:
1. By card banking
You can make your payment directly online on our sites internet with your Carte Bleue, E-cartebleue (Pay and Payline system), Visa, Visa Electron, Maestro and MasterCard
You can also pay your purchases by check when you place your order. Just send it to us by mail, and it will have to be made payable to MINI EXPRESS.
3. By direct debit
If you opt for direct debit to pay for your purchases, you will need to send us the direct debit authorization (available on the website www.otto-models.com) duly completed and signed, accompanied by your RIB
However, this means of payment is not available for orders placed online on our website, www.otto-models.com, but only for pre-orders.
Checks and direct debits are cashed 15 days before shipping. This period allows us to check the solvency of the settlement. No reduction will be applied to the price indicated on the site www.otto-models.com for cash payment. In the absence of payment, the sending of the order and the reservation will be cancelled.
Any unpaid or payment incident (incorrect bank details, lack of funds in the customer's account, etc.) will be charged €15.40 including tax.
1. Legal right of withdrawal
You have a period of 14 days for you withdraw, from the receipt of your product (by you or a third party, other than the carrier, appointed by you). You can return the product(s) at your expense, without any explanation. THE) product(s) must be returned in their original packaging, with all accessories and intact. You must notify your wish to withdraw via the attached form or by mail (here).

2. Effects of withdrawal
We will reimburse you for all payments we have received from you, including standard delivery charges (i.e. corresponding to the cheapest delivery we offer) no later than 14 days from the receipt of your withdrawal request. We will use the same payment method used during your initial order. The refund will not incur any additional costs for you. We may withhold payment until we have received the product(s)
The delivery address may be different from the billing address. One and/or the other must be indicated on the order or when registering for our Club.
Orders placed on the online store www.otto-models.com are processed within a maximum of fifteen (15) working days from from their date of receipt by MINI EXPRESS SARL or their deposit on the sites web.
Reservations made by mail or through the website www.club-ottomobile.com or by email can be delivered within 30 days from the 3rd week of the month concerned by the reservation. The month is always stipulated on the reservation documents.
MINI EXPRESS SARL takes the provisions necessary to minimize the risks during transport. These risks are borne by of the Buyer from the moment the ordered item leaves the premises of MINI EXPRESS SARL. In case damage during transport, the reasoned protest must be made to the carrier within a period of three days from delivery.
It is the buyer's responsibility to refuse the package or of report the condition of the package on the delivery note in order to be able to make any complaint to the carrier.
Unless otherwise stipulated at the time of the Order, any delivery made beyond a period of thirty (30) days through the fault of MINI EXPRESS SARL may give rise to the termination of the order by the Buyer and its reimbursement.
If the Buyer does not recover not his package within the time specified by the carrier (by email) at the indicated collection point, the parcel will be returned to MINI EXPRESS SARL and the return of the order will be the responsibility of the Buyer.

All disputes to which the purchase transactions concluded pursuant to the these general conditions of sale and which would not have been the subject of an amicable settlement between the seller or by mediation, will be submitted to the competent courts under the conditions of common law.

MINI EXPRESS SARL guarantees that the products are in perfect condition during the handed over to the carrier. This is the only guarantee granted by MINI EXPRESS SARL.
No other express or implied warranty is granted. In particular, MINI EXPRESS SARL cannot guarantee that the products meet the specific expectations of the customer.
MINI EXPRESS SARL cannot be held responsible for non-performance of the contract concluded in the event of force majeure, disruption or strike total or partial, in particular, postal services and means of transport, flood or fire.
MINI EXPRESS SARL will not incur any liability for any consequential damages resulting from present (operating loss, loss of profit, loss of opportunity, damages or costs).
Our packaging boxes (polystyrene, OttO white box and brown cardboard) are used to protect our models during transport; they cannot be exchanged in the event of scratches or slight deformation.
Our site may provide, or third parties may include, links to other websites or other internet sources. Insofar as MINI EXPRESS SARL cannot control these sites and these sources external parties, each user acknowledges that MINI EXPRESS SARL cannot be held responsible for the provision of these sites and external sources, and cannot bear any responsibility for to the content, advertisements, products, services or any other material available on or from these sites or external sources.

DISPUTE SETTLEMENT – MEDIATION – AFTER-SALES SERVICE
1. After-sales service
Only sales made directly by MINI EXPRESS SARL (by the online store or by the CLUB OttO) are likely to be the subject of a request for after-sales service or exchange parts. For other types of sales (Ebay, Le Bon Coin, stores, etc.), customers should contact their seller.
Any complaint concerning the quality of the products shipped must be made within 14 days of receipt of the package.
